But health concerns have led the EU commission to withdraw authorisation for eight primary smoke flavouring ingredients. In 2024 the European Commission decided to ban eight smoke flavouring primary products with specific transition periods.

Which product categories are affected by this regulation?
Text

The regulation will impact final food products containing primary smoke products (i.e. snacks, sauces, processed meat) and also compounded smoke flavouring formulations.

Is there a transition period for existing products?
Text

Yes, there is a transition period:
 

  • Primary smoke products can be used in the following final food products until 1 July 2029: Cheese, meat, processed fish and fishery products including crustaceans and molluscs, fish roe and corresponding sub-categories.
  • For all other categories, primary smoke products can be used in final food products until 1 July 2026.

 
The transitional measures apply to both the final food and to compounded flavouring formulations.

What should companies do to prepare?

If your company sells these products, you will need to review your recipes and reformulate them quickly to comply with the new regulations.

How do primary smoke-free flavouring solutions differ from smoke flavourings solutions?

Primary smoke-free flavouring solutions with smoke flavour profiles are not impacted by the regulatory changes. Primary smoke free flavouring solutions can be labelled as natural flavourings according to current EU regulation for flavourings 1334/2008.
