Terms of Use applying to the Givaudan Eve application (the “Terms of Use”)

Welcome on Eve, the Givaudan Active Beauty iPad interactive interface (the “App” or “Eve”)
The App is a part of Givaudan websites. By using Eve, you agree that you have read, understood and given your consent to the Terms of Use, including the terms of use of the Givaudan web site available at https://www.givaudan.com/legal. The Terms of Use notably specify Givaudan’s privacy statement with respect to personally identifiable information that you share with us either through the set-up of your account or through your use of the App (“your Data”). Please, be aware that no transmission over the Internet can be guaranteed to be 100% secured. Therefore, we cannot warrant total security of your Data when transiting over the Internet.
Using Eve application
Content available in the App. Eve helps you to create a customer brief in order to match all your needs with the perfect Active Beauty ingredients. Givaudan may update the app from time to time. You are responsible to regularly update it by getting connected to Eve when there is an internet connection on your device (WIFI or 3G/4G).
Functionalities of the App. This interactive interface offers you the possibility to answer your customers’ needs by filling few items. You can answer to each of them or only on those you want. There are 8 items:
- Consumer profile: To describe your target
- Regions of launch: To select where your product will be sold
- Compliancy: To fit with a particular type of regulation
- Product category: To indicate what kind of product you will create
- Claims: To explain the purpose of your product
- Trends & Inspirations: To follow a trend or an inspiration
- Type of formula: To specify the type of product
- Price range: To evaluate the price range
After responding to everything you want, Eve will summarise all actives matching with your needs. You only have to select those you are interested in and to create your formula. In order to have a detailed report, please fill your contact information to receive it by mail. The details of your brief are stored by Givaudan and can be accessed by Givaudan authorised personnel for purposes of quality insurance and technical assistance.
Information management during the set up. To be able to use Eve, you need to sign up for an account. Some personally identifiable informations such as your professional email address are requested. This is used by Givaudan to authorise the access to Eve on your device and are part of your Data.
Information management during your use of Eve. We may collect other information when you use Eve, which are also part of your Data, as follows:
- Device information: We collect and store device-specific information such as your hardware model and your iOS version to be sure that it will be compatible with the App.
- Log information: We collect and store the time at which you connect to the App is automatically registered. This information is collected and stored by Givaudan solely for the purpose of making aggregated statistics in order to determine the aggregated level of use of the App. Givaudan will not use this information for tracking or monitoring purposes.
- Location information: If you authorise the location of your device, Givaudan may collect the GPS signal of your device. Please note that Givaudan may collect such information only for the purposes of making aggregated statistics about which country the App is used from. Givaudan will not use this information for tracking or monitoring purposes.
How we use information we collect. Your Data that Givaudan collects through Eve are used for the above mentioned purposes and in order to keep improving the App, to check that your use of it complies with the Terms of Use and to protect Eve and its content (e.g. to make sure you are using the latest version). Your Data are stored for the time of your employment relationship (if you are a Givaudan employee) or for the time of your contractual relationship (if you are a contractor of Givaudan). At the end of either relationship, your user account and your Data are deleted and removed from the servers. They are stored by Givaudan on Google Compute Engine servers, hosted in Western Europe. Your Data may also be disclosed if Givaudan is legally required to do so. By selecting “Accept” and/or downloading the App, you agree with the transfer of your Data to entities located in different countries than your country of residence. You have a right to review your Data held by Givaudan and to have certain inaccurate information about you corrected. You also have a right to request the deletion of your Data at any time. If you wish to do so, or to notify Givaudan of a change in your details, please contact Givaudan administrator via the contact email: justine.catala@givaudan.com.
Protection of the App. To protect Eve, a personal password is given to you at your first connection. You must keep your password confidential. You have to inform Givaudan immediately in case your contract with Givaudan terminates or if a member of your team leaves. Upon termination of the contract between you or your company and Givaudan, all the Eve’s accounts will be cancelled, and the content of the App will be automatically deleted on the devices.
Your responsibilities. You are responsible for the activity that happens on your iPad. You must keep your iPad in a safe place, under your vigilance (especially on exhibitions). In case you lose your device, or if someone steals it, you must IMMEDIATELY inform Givaudan (contact email: justine.catala@givaudan.com). The App is intended to be used for the sole purpose of promoting Givaudan’s products to customers. It is strictly prohibited to generate screen captures, to (try to) reverse engineer by any means this software or its content, to share and show the App or its content to any third party (including, but not limited to, Givaudan’s competitors) other than your company’s personnel and customers. It is your responsibility to maintain the software of the App updated when you receive the corresponding update notification, as well as to maintain its content up to date. Givaudan may block your usage of the App after a certain time in case you don’t take the proper actions to update the software or the content of Eve.
Information about the App. You may receive information concerning Eve (e.g. important updates) on your email.
Copyrights
All the application is the property of either Givaudan SA or its affiliated companies, or is used with the authorization of the owners, and subject to copyright. You may only use it for professional purposes in order to help you answer the customers’ needs.
All briefs sent through the follow up emails are the property of Givaudan.
Modifying and terminating this service
Givaudan makes no representation or warranties, expressed or implied, as to the continuity of the App. Givaudan may stop your access to and/or use of the App with immediate effect notably in case of a breach of the Terms of Use (such as, but not limited to: sharing the App’s content with Givaudan’s competitors or with other suppliers, (attempt to) hack the interface, etc.), or if you inform Givaudan that an iPad on which the App is installed has been lost or stolen.
About these Terms
We reserve the right to modify the Terms of Use at any time. Your continuous use of the App shall constitute your acceptance of the new Terms of Use.
